Introduction

These terms and conditions (“Terms”) apply to the purchase and sale of handmade candles (“Candles”) sold by Chix and Wix, LLC and is intended to protect Chix and Wix, LLC from any liability arising from the sale of handmade candles (“Candles”). By placing an order for Candles, you agree to be bound by these Terms.

Use of Candles

Chix and Wix, LLC makes no representation or warranty with respect to the suitability of the Candles for any particular purpose. The customer assumes all responsibility for the use of the Candles and any risks associated therewith.

Allergies and Sensitivities

Some people may have allergies or sensitivities to certain fragrances or materials used in the Candles. Chix and Wix, LLC recommends that the customer review the ingredients and materials used in the Candles before purchasing and using them. Chix and Wix, LLC will not be responsible for any adverse reactions the customer may experience.

Burn Safety

The customer agrees to follow all burn safety guidelines, including but not limited to keeping the Candles away from flammable materials and not leaving them unattended while burning. Chix and Wix, LLC will not be responsible for any damages or injuries that may occur as a result of improper use of the Candles.

Orders

All orders for Candles must be placed through Chix and Wix, LLC or in-person with Chix and Wix, LLC employee. Orders are subject to acceptance by Chix and Wix, LLC and availability of the Candles. Chix and Wix, LLC reserves the right to reject any order for any reason.

Payment

Payment for Candles must be made in advance, prior to shipping. Chix and Wix, LLC accepts cash (in-person) US-issued and most internationally-issued magstripe or chip cards bearing a Visa, MasterCard, American Express, Discover, JCB, or UnionPay logo.

Shipping

Chix and Wix, LLC will ship the Candles to the address specified by the customer at the time of purchase. Chix and Wix, LLC will use commercially reasonable efforts to ship the Candles within a week. Chix and Wix, LLC is not responsible for any shipping delays or damage that may occur during shipment.

Returns and Refunds

Chix and Wix , LLC stands behind the quality of its Candles and offers a return and refund policy. To initiate a return or refund, the customer must contact Chix and Wix, LLC within 2 weeks of receiving.

Warranty

Chix and Wix, LLC warrants that the Candles will be free from defects in material and workmanship for 2 weeks of receiving. If a Candle is found to be defective during the warranty period, 2 weeks of receiving, Chix and Wix, LLC will replace it at no cost to the customer.

Limitation of Liability

Chix and Wix, LLC will not be liable for any indirect, incidental, special, or consequential damages arising out of the use of the Candles, even if Chix and Wix, LLC has been advised of the possibility of such damages.

Indemnification

The customer agrees to indemnify, defend, and hold harmless Chix and Wix, LLC, its employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, and expenses (including but not limited to attorney’s fees) arising out of or in connection with the customer’s use of the Candles.

Changes to Terms

Chix and Wix, LLC reserves the right to make changes to these Terms at any time and without prior notice. The most current version of the Terms will be available on www.ChixAndWix.com.

Governing Law

This disclaimer will be governed by and construed in accordance with the laws of the Virginia, US.

Copyright Disclaimer

All web images and Chix and Wix, LLC company branding displayed on this website are protected by copyright law. The images and logos are the exclusive property of Chix and Wix, LLC and are subject to copyright protection under applicable laws.

Unauthorized use, reproduction, distribution, or modification of these images and logos without the express written consent of Chix and Wix, LLC may constitute a violation of copyright laws. Any unauthorized use may result in legal action and potential liability for copyright infringement.

All rights, including but not limited to the rights of reproduction, distribution, display, and modification, are reserved by Chix and Wix, LLC. Any use of these images and logos for commercial or non-commercial purposes must be explicitly authorized in writing by Chix and Wix, LLC.

Entire Agreement

These Terms constitute the entire agreement between Chix and Wix, LLC and the customer with respect to the sale of Candles and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, relating to the Candles.

Event Cancellations and Refunds

Cancellations by Customers:

No Refunds Policy: Due to the specialized nature of our Events and the advance preparation of materials, Chix and Wix, LLC does not offer refunds for Event cancellations made by customers.

Event Credits:

Customers who notify Chix and Wix, LLC of their inability to attend at least 72 hours before the scheduled Event may receive a credit equal to the registration amount, which can be applied toward:

• A future Chix and Wix Event
• Products from our online or in-person store
• A gift for someone else

Credit Validity:

Event credits must be used within 6 months of issuance.

Transfers:

Customers may transfer their registration to another person by notifying Chix and Wix, LLC at least 24 hours before the scheduled Event with the name and contact information of the substitute attendee.

Cancellations by Chix and Wix, LLC:

If Chix and Wix, LLC must cancel an Event due to unforeseen circumstances, including but not limited to weather conditions, instructor illness, or insufficient registration, customers will be offered the choice of:

• Full refund of the registration fee
• Credit toward a future Event
• Alternative Event date, if available

Chix and Wix, LLC will make reasonable efforts to provide at least 24 hours' notice of any Event cancellation.

Special Circumstances

Chix and Wix, LLC reserves the right to make exceptions to this policy on a case-by-case basis for verifiable emergencies or extenuating circumstances. Such exceptions are at the sole discretion of Chix and Wix, LLC management and do not constitute a waiver of this policy for future Events.

Private Events and Group Bookings

Private Events and group bookings of 6 or more participants are subject to separate terms and conditions that will be provided at the time of booking.
